How to rent out your property in Portugal: the landlord’s step-by-step guide

Renting out a home in Portugal is ten steps, and the order matters: owners who start with the listing and end with the paperwork lose weeks. This guide walks the whole path, from the property file to the tax return, with the law in force and links to the guides that go deeper on each topic. It works for owners living in Portugal and for those letting from abroad.

In short: gather the property tax record, the habitation licence and the energy certificate; set the rent from the median of real leases in the parish (INE); choose the tenant on documents, not conversation; sign a written lease with a minimum term of 1 year; report it to the tax authority through Modelo 2 by the end of the following month; issue an electronic receipt for every rent; and declare the rents under IRS category F, at 25% or 10% for long leases.

The ten steps

  1. 1. Gather the property documents

    Before advertising, make sure you have everything the lease and the tax authority will ask for. Without a habitation licence and a valid energy certificate you cannot sign a residential lease.

    • Up-to-date property tax record (caderneta predial, from the tax portal)

  2. 2. Decide: long-term, not short-term letting

    This guide covers long-term residential letting: a written lease, a tenant with their tax address at the property, rent receipts filed with the tax authority and IRS category F. Short-term letting (alojamento local) is a different law, different taxation and a different operation, with its own restrictions in Lisbon. The two do not mix.

  3. 3. Set the rent from real leases

    Portals show what owners ask, not what gets signed. Statistics Portugal publishes the median rent of new leases by parish, from the leases reported to the tax authority. Start from that number and adjust for floor area, condition, floor, view and furnishing. A flat priced above the market waits for months and loses more than it gains.

  4. 4. Prepare the home and the photos

    Small repairs, a deep clean, utility meters in the owner’s name and ready to transfer, photos in natural light. Decide whether to let furnished (slightly higher rent, longer inventory) or unfurnished (more stable tenants). A photographic inventory made now is worth gold at check-out.

  5. 5. Advertise and choose the tenant

    Ask every candidate for the same documents and decide on the numbers: ID, employment contract or proof of activity, the last three payslips and the last tax return. The rule of thumb is that rent should not exceed one third of the household’s net income. A guarantor or a deposit adds security; ask only for the data you need and keep it only until the decision (GDPR).

  6. 6. Draft and sign the lease

    A residential lease must be in writing and identify the parties, the property, the habitation licence (number, date and municipality), the rent, the term and the deposit. For permanent housing the minimum initial term is 1 year (except transitional purposes) and the maximum 30 years; at the end it renews automatically. Write the deposit and any advance rent into the lease: what is not written does not exist.

  7. 7. Report the lease to the tax authority (Modelo 2)

    By the end of the month following the start of the lease, report it on the tax portal through Modelo 2 (stamp duty) and pay the stamp duty due. This filing is what allows you to issue electronic rent receipts and, if ever needed, to use the special eviction procedure at the Balcão do Arrendatário e do Senhorio.

  8. 8. Hand over the keys with an inspection

    On move-in day, walk through the home with the tenant and sign an inspection report with photos and meter readings; annex it to the lease. Transfer, or instruct the transfer of, the water, electricity, gas and internet contracts. This document decides the deposit settlement at the end.

  9. 9. Every month: rent and receipt

    Rent falls due on the agreed date (by law, on the first business day of the month before the one it refers to, unless agreed otherwise). For every rent received, issue the electronic receipt on the tax portal by the end of the following month; exempt landlords file the annual Modelo 44 by the end of February instead. If rent is late, the law gives 8 days’ grace and then a 20% penalty.

  10. 10. Declare the rents (IRS category F)

    Rents are property income, declared in Anexo F between 1 April and 30 June of the following year. Tax is paid on net income: IMI, condominium fees, insurance, the lease stamp duty, maintenance works, management fees and the energy certificate are deductible with invoices. The general rate is 25%; from 2026 to 2029, residential leases with rent up to €2,300 and a minimum term of 3 years pay 10%.

Can I let without a habitation licence?

No, unless the building predates 1951 and you can prove it. The licence must appear in the lease (number, date and issuing municipality). Without it the lease may be deemed invalid and the tenant may seek termination.

Is the energy certificate mandatory to let?

Yes: it is mandatory to advertise and to sign the lease. A qualified expert issues it and the cost is tax-deductible.

How much deposit can I ask for?

The deposit and any advance rent have legal limits and must be written into the lease. In practice the market asks for one to two months’ deposit and one month in advance. It is returned at the end, less what the check-out inspection documents.

How long does it take to report the lease to the tax authority?

It is done online on the tax portal in minutes, through Modelo 2 (stamp duty), by the end of the month following the start of the lease. Without this filing you cannot issue electronic rent receipts.

Do I have to issue a receipt every month?

Yes, one electronic receipt per rent received, by the end of the following month, unless exempt (for example landlords aged 65 or over who have not opted into electronic receipts), in which case the annual Modelo 44 is filed by the end of February.

It depends on your time, the distance you live at and how many properties you have.
