Lease agreement template for Portugal: download and fill in without mistakes

A residential lease in Portugal does not need to be expensive or complicated, but it must follow the form and content Portuguese law requires. We prepared a free Word template, no sign-up needed, and this guide explains what the contract must contain, the most common mistakes when filling it in and what to do after signing.

What the contract must contain
Before filling anything in, check that the document covers these six points. Our template already does; if you use another one, verify them one by one.
- Written form: a residential lease in Portugal must be made in writing and signed by both parties, with one copy for each.
- Full identification: names, tax numbers (NIF) and ID documents of landlord and tenant, plus the property’s address and land registry reference. Without the NIFs, you cannot register the lease with the tax office.
- Use licence (licença de utilização): the contract should state the number, the date and the municipality that issued the property’s use licence.
- Term and renewal: for permanent housing, the minimum initial term is 1 year (except transitional housing needs) and the maximum is 30 years. At the end of the term the lease renews automatically, with a 3 year minimum renewal when the term is shorter, unless the contract says otherwise.
- Rent and annual update: amount, payment day and method, and the annual update by the coefficient published by INE (for 2026: 1.0224, a maximum increase of 2.24%).
- Deposit and advance rents: if there are any, the contract must state the amount, what they cover and how and when they are returned.
The 5 most common mistakes when filling in a template
A good template does not prevent bad filling in. These are the mistakes we see most often in signed contracts.
- Leaving fields unfilled: the fields come in square brackets; re-read the final document and delete the clauses that do not apply to your case, instead of leaving them to contradict the rest.
- Treating the term as a guaranteed end date: a 1 year lease does not end after 1 year: it renews automatically, the renewal lasts at least 3 years (unless the contract says otherwise), and the landlord’s opposition to the first renewal only takes effect 3 years after the contract was signed.
- Forgetting the rent update clause: the annual update requires a one year interval and written notice at least 30 days in advance; increases you fail to apply are lost for good.
- Taking a deposit without writing it down: the amount, its purpose and the conditions for returning it must be on paper, and every sum received should have a receipt.
- Signing without an inspection report: without the property’s condition documented at move-in, room by room and with meter readings, any damage at the end of the lease turns into a word-against-word dispute.

After signing: tax office and receipts
The signature does not close the process. Two steps remain, and they condition everything else.
- Register the lease with the tax office: through Modelo 2 of the Stamp Duty (Imposto do Selo), by the end of the month following the start of the lease. This registration is what lets you issue electronic rent receipts and, if ever needed, use the special eviction procedure at the Balcão do Arrendatário e do Senhorio (BAS).
- Issue electronic rent receipts: as a rule on the Portuguese tax portal, month by month, unless you are exempt under the law. The receipt amounts later appear pre-filled in Annex F of the IRS return.

When a generic template is not enough
This template covers the typical residential lease: one home, one landlord, one tenant (or a couple). Some situations call for tailored clauses:
- Subletting, in whole or in part
- Renting out individual rooms, with several contracts in the same property
- Landlords or tenants who are not resident in Portugal, with tax obligations of their own
- Non-residential use, or situations where the parties are already in dispute

Does a lease in Portugal have to be in writing?

Without it, you lose the fastest route if the tenant stops paying.
Can I use this template to rent out a room or to sublet?
It is not the right fit. Rooms, subletting, non-residential use and non-resident parties call for specific clauses: use the template as a reference and have the final version checked by a lawyer.
